SprichstDu — Terms and Conditions of Use

Welcome to SprichstDu ("the Service"). By creating an account or using the Service, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. About the Service

SprichstDu is a free daily email service that delivers structured German vocabulary lessons to registered users. The Service is operated from Germany and intended primarily for users residing in the European Union.

The Service includes: daily lesson emails sent Monday through Friday, a web-based dashboard for reviewing vocabulary and past emails, and optional one-tap feedback on each lesson.

2. Eligibility and Registration

You must be at least 16 years old to create an account. By registering, you confirm that you meet this age requirement.

To sign up, you must provide a valid email address, select your native language, choose a German proficiency level (A1–B2), and set a preferred delivery time. You are responsible for keeping your account credentials secure and for all activity under your account.

3. The Service Is Free

SprichstDu is currently provided free of charge. No credit card or payment information is required. We reserve the right to introduce optional paid features in the future, but your existing free access will not be retroactively restricted without notice.

4. Email Communications

By signing up, you consent to receive daily lesson emails at the time you selected (morning or afternoon, CET). You may also receive occasional service-related emails such as a welcome message, level completion notices, or important service updates.

You can pause or stop daily emails at any time through the Settings page or by clicking the unsubscribe link in any email. Unsubscribing stops lesson delivery but does not delete your account. You can re-enable emails at any time.

5. User Conduct

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service or its systems; interfere with or disrupt the Service for other users; create multiple accounts to abuse feedback or other features; or share your account credentials with others.

We reserve the right to suspend or terminate accounts that violate these terms.

6. Intellectual Property

All content delivered through SprichstDu — including lesson texts, example sentences, grammar explanations, email designs, and the SprichstDu brand — is the intellectual property of SprichstDu and its operators.

You may use lesson content for your personal, non-commercial language learning. You may not reproduce, redistribute, or republish lesson content in bulk without prior written permission.

7. Content Accuracy

SprichstDu aims to provide accurate and helpful German language content. However, lesson content is generated with the assistance of AI tools and may occasionally contain errors in grammar, vocabulary, or translation.

The Service is a supplementary learning tool and does not guarantee any specific learning outcomes, language proficiency levels, or preparation for official examinations (e.g., Goethe-Zertifikat, telc, TestDaF). Users should not rely on SprichstDu as their sole source of German instruction.

8. Data and Privacy

We collect and store the following data: your email address, chosen native language, German level, delivery time preference, learning progress, email open events, and optional lesson feedback.

Your data is stored on servers within the EU (Supabase, EU region) and processed by third-party services including Resend (email delivery) and Vercel (hosting). All services are selected for GDPR compliance.

For full details on how we handle your data, please refer to our Privacy Policy. You have the right to access, correct, export, or request deletion of your personal data at any time.

9. Feedback Data

When you tap a feedback button in a lesson email ("Used it" / "Got it" / "Too hard"), your response is recorded anonymously using a signed token. No login is required for feedback. Feedback data is used solely to improve lesson quality and the learning experience.

10. Account Deletion

You can delete your account through the Settings page. Account deletion signs you out and stops all email delivery. For complete deletion of all stored data, please contact us at hallo@sprichstdu.de. We will process data deletion requests within 30 days in accordance with GDPR.

11. Service Availability

We strive to deliver emails reliably every weekday, but we do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, technical issues, or factors beyond our control. We are not liable for any missed emails or interruptions.

12. Limitation of Liability

SprichstDu is provided "as is" without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

Nothing in these terms limits liability for intentional misconduct or gross negligence, or any other liability that cannot be excluded under German law.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

14. Governing Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from or in connection with these terms shall be subject to the jurisdiction of the courts in Berlin, Germany, unless mandatory consumer protection rules require otherwise.
